Help Ngày ON BOARD và ngày vận đơn

Dear mọi người,

Mình có một thắc mắc như sau: DN mình nhận được một vận đơn có ngày ON BOARD là ngày 11/7, nhưng ngày ISSUE lại là ngày 10/7. Không biết như thế thì có phù hợp không nhỉ? Vì theo mình hiểu/ nhớ thì phải On board rồi mới được phát hành B/L chứ?

Không nhất thiết phải như thế đâu. Mình gặp rất nhiều ngày onboard và ngày issue B/L khác nhau đấy.

mình biết là có thể khác nhau nhưng mà theo mình thì ngày On board phải trước ngày B/L chứ.

Ngày On Board trước hoặc đúng ngày BILL thường chỉ áp dụng cho MBL (các hãng tàu kỹ hơn trong vấn đề này).
Còn với HBL thì bình thường nhé, có thể forwarder issue BILL sớm hơn để xin C/O, nếu tàu delay sẽ re-issue lại BILL và C/O.

on board là ngày hàng được chất lên tàu và tàu chưa chạy, trường hợp này mình đã thấy ở vận đơn của MCC, theo dõi thì thấy departing là đúng với issused B'L date. Nên căn cứ vào issued date đó.

On board date = Laden on board vessel = Depart date = Ngày tàu khởi hành ra khỏi Cảng.
Date of issue of BL chỉ đơn giản là ngày in BILL ra và MCC sẽ lấy làm ngày release trên hệ thống thôi nhé.

Ý mình là có thể xảy ra trường hợp mà Date of Issue trước ngày Shipped on board không mà?

1) Laden on board = Confirmation from the entity issuing the bill of lading that the cargo has been loaded on board and when accompanied with a date, it means that the cargo described on the bill of lading has been loaded on board the ship on the specific date mentioned..
If no date is mentioned, the bill of lading date will be deemed to be the date that the cargo was loaded on board..
Laden on board only means that the cargo has been loaded on board and should not be construed as the ship having sailed with the cargo..
This specific notation however is not very widely used as compared to a shipped on board notation..
2) Shipped on board = Confirmation from the entity issuing the bill of lading that the cargo has been loaded on board and the ship has sailed.. When accompanied with a date, it means that the cargo described on the bill of lading has been loaded on board the ship and the ship has sailed on the specific date mentioned..
If no date is mentioned, the bill of lading date will be deemed to be the date of shipment..

Laden on board = cargo has been loaded on ship
Shipped on board (SOB) = cargo has been loaded and ship has sailed
Vessel departure = vessel sailed

The latest (July 2007) revision of UCP is UCP600 Article 20 – Section A – sub-section ii clarifies this point as below:

– An on board notation indicating the date on which the goods have been shipped on board.

- The date of issuance of the bill of lading will be deemed to be the date of shipment unless the bill of lading contains an on board notation indicating the date of shipment, in which case the date stated in the on board notation will be deemed to be the date of shipment.
